गुजरात विधानसभा ने गुरुवार को बहुमत से गुजरात निषेध अधिनियम में संशोधन करने वाला एक विधेयक पारित किया, जो राज्य सरकार को शराब तस्करी के मामलों में पुलिस द्वारा जब्त किए गए वाहनों की नीलामी करने का अधिकार देता है। गृह राज्य मंत्री हर्ष सांघवी द्वारा पेश किए गए विधेयक का आप के चार विधायकों ने विरोध किया, जबकि कांग्रेस विधायक दिन भर सांघवी ने कहा कि जब्त किए गए वाहनों को नीलामी के माध्यम से बेचकर एकत्र किए गए धन का उपयोग गरीबों के लिए कल्याणकारी योजनाओं में किया जाएगा।
गुजरात निषेध (संशोधन) विधेयक-2024 में कहा गया है कि मूल अधिनियम के प्रावधानों के अनुसार, निषेधाज्ञा के मामलों में जब्त किए गए वाहनों को अदालत के फैसले तक बांड या जमानत पर रिहा करने की अनुमति नहीं थी, यदि आरोपी 20 लीटर से अधिक शराब का परिवहन करते हुए पाया जाता है उस वाहन में. परिणामस्वरूप, जब्त किए गए वाहन पुलिस स्टेशनों या अदालत परिसर में कई वर्षों तक अप्रयुक्त पड़े रहते हैं और उनकी स्थिति खराब हो जाती है। इसमें कहा गया है कि इस स्थिति से उबरने के लिए, सरकार ने नीलामी के माध्यम से ऐसे वाहनों का निपटान करने के लिए अधिनियम में संशोधन करना आवश्यक समझा है। विशेष रूप से, सरकार ने 31 जुलाई को इस विषय पर एक अध्यादेश जारी किया था और विधेयक उसी का स्थान लेगा। सांघवी ने विधेयक पेश करते हुए कहा, “हाई-स्पीड वाहन बूटलेगर्स का सबसे बड़ा उपकरण हैं… पिछले दो वर्षों में, बूटलेगिंग के संबंध में 22,442 वाहन जब्त किए गए हैं। इनमें से 7,213 वाहन अभी भी पुलिस स्टेशनों में पड़े हुए हैं।” उन्होंने कहा कि जब्त किए गए वाहनों में लगभग 300 शानदार कारें शामिल हैं, जो विभिन्न पुलिस स्टेशनों में पड़ी हैं। सांघवी ने कहा कि गुजरात यह कानून लाकर इस समस्या का समाधान करने वाला देश का पहला राज्य है। उन्होंने कहा कि एक डीएसपी-रैंक अधिकारी वाहनों की नीलामी करेगा, अगर आरोपी बरी हो जाता है, तो उसे नीलामी का पैसा ब्याज सहित वापस मिल जाएगा।
