2019 में, अमृत पाल जयवाल और उनके परिवार ने नई दिल्ली से एडमोंटन, कनाडा की यात्रा के लिए जेट एयरवेज की उड़ान बुक की। कुल मिलाकर, परिवार ने टिकटों के लिए 1.83 लाख रुपये का भुगतान किया। लेकिन इससे पहले कि वे यात्रा पर निकल पाते, जेट एयरवेज दिवालिया हो गई और उसने अपना कारोबार बंद कर दिया। पांच साल बाद, 7 अगस्त को, राष्ट्रीय उपभोक्ता विवाद निवारण आयोग (एनसीडीआरसी) ने परिवार के पक्ष में फैसला सुनाया, और गोइबिबो, जिस प्लेटफॉर्म के माध्यम से टिकट बुक किए गए थे, को जयवालों को पैसे वापस करने का निर्देश दिया।
मामले में मुख्य मुद्दा यह था कि क्या कोई ऑनलाइन ट्रैवल एजेंसी उड़ान संचालित करने में एयरलाइन की विफलता के मामले में प्राप्त किराया वापस करने के लिए उत्तरदायी थी। अपनी दलीलों में, गोइबिबो ने कहा था कि वह इस मामले में उपभोक्ता और सेवा प्रदाता, जेट एयरवेज के बीच केवल एक “सुविधाकर्ता” था। इसमें यह भी कहा गया है कि उनके उपयोगकर्ता समझौते में स्पष्ट रूप से कहा गया है कि संबंधित सेवा प्रदाता, जो इस मामले में एयरलाइन है, के अंत में कंपनी की गैर-परिचालन उड़ानों के लिए कोई दायित्व नहीं होगा।
कंपनी ने तर्क दिया कि एक बार ग्राहक को टिकट जारी करने के बाद, वह अपने कर्तव्यों से मुक्त हो जाती है। हालाँकि, एनसीडीआरसी ने उपभोक्ता का पक्ष लिया और ट्रैवल एजेंसी को उपभोक्ताओं को रिफंड देने के लिए उत्तरदायी ठहराया। पिछले साल अगस्त में पंजाब उपभोक्ता आयोग ने भी उपभोक्ता का पक्ष लिया था, जिसके बाद गोइबिबो ने एनसीडीआरसी से संपर्क किया था।
पंजाब आयोग ने कहा था कि एजेंसी के अपने दिशानिर्देशों के अनुसार, वह उन टिकटों के रिफंड के प्रबंधन के लिए जिम्मेदार होगी जिनका उपयोग नहीं किया जा रहा है। एनसीडीआरसी ने जयवाल और उनके परिवार को रिफंड देने के लिए एजेंसी को जिम्मेदार ठहराते हुए राज्य आयोग की इस टिप्पणी पर भी भरोसा किया। एनसीडीआरसी के पीठासीन सदस्य डॉ. इंद्रजीत सिंह ने 7 अगस्त के आदेश में कहा, “(पंजाब) राज्य आयोग ने एक उचित आदेश दिया है और हम इसकी टिप्पणियों और निष्कर्षों से सहमत हैं।”
